    Nigerian EIA Process: Which Projects Require an EIA and Which Do Not

    One of the most common questions developers ask early in the planning stage is whether their project requires a full Environmental Impact Assessment. Understanding where your project fits within the Nigerian EIA process can save significant time and money before construction begins.

    The answer is not based on a fixed project-type checklist. FMEnv categorises projects using a defined set of criteria, and the outcome of that categorisation determines what level of environmental assessment is required.

    How Does FMEnv Categorise Projects Under the Nigerian EIA Process?

    During the Screening stage — also called the Initial Environmental Evaluation or Site Verification — FMEnv assigns every project to one of three categories. This assessment is guided by the EIA Act Cap E12 LFN 2004 and is based on the following criteria:

    • Magnitude of the project
    • Extent or scope of the activity
    • Duration and frequency of impacts
    • Risks associated with the project
    • Significance of potential environmental effects
    • Mitigation measures available for associated and potential impacts
    • Location of the project, particularly whether it falls within or near an Environmentally Sensitive Area (ESA)

    A project that appears modest in type can still attract a full EIA if its size, location, or potential impacts meet the threshold. The categorisation is never automatic.

    Before Anything Else: Engage an Accredited Environmental Consultant

    The first practical step for any project developer is engaging an accredited environmental consultant. The consultant is involved from the very beginning of the process, not partway through.

    They help the proponent understand what is required, develop the Terms of Reference, prepare the registration documents, conduct the EIA studies, and produce the report submitted to FMEnv for review.

    FMEnv will not accept an EIA report that has not been prepared by a registered practitioner. Engaging the right consultant early reduces the risk of avoidable revision cycles later.

    Category I: Full EIA Required

    Category I projects have significant potential environmental impacts and require a full-scale EIA before any approval is granted. The Nigerian EIA process applies fully to these projects, from TOR submission through to certificate issuance. FMEnv’s official categorisation checklist includes the following:

    • Agriculture and Agro-allied: Land development schemes covering 500 hectares or more; agricultural programmes requiring resettlement of 100 or more families; saw milling and wood/timber processing
    • Industry and Manufacturing: Chemical plants producing more than 100 tonnes per day; petrochemicals of all sizes; cement and lime production above defined thresholds; iron and steel facilities; shipyards; pulp and paper plants
    • Food, Beverages and Tobacco: Construction of food processing plants; brewery plant construction
    • Infrastructure: Expressways, national highways, industrial estates covering 50 hectares or more, hospitals with beach outfall, and new townships
    • Ports: Construction of new ports; port expansion involving an increase of 50 percent or more in handling capacity
    • Airports: Construction of airports with airstrips of 2,500 metres or longer; airstrip development in national parks
    • Power Generation: Steam power stations above 10 megawatts; hydroelectric dams above defined thresholds; combined cycle and nuclear power stations
    • Railways: Construction of new routes and branch lines; mass rapid transport projects
    • Mining: Mining leases covering more than 250 hectares; ore processing for aluminium, copper, gold or tantalum; sand dredging covering 50 hectares or more
    • Petroleum: Oil and gas field development; pipelines; refineries; processing and storage facilities
    • Quarries: Quarrying within 3 kilometres of any residential, commercial or industrial area
    • Waste Treatment: Incineration, recovery, treatment and landfill facilities for hazardous, municipal solid waste and sewage
    • Water Supply: Dams and reservoirs covering 200 hectares or more; groundwater development above 4,500 cubic metres per day
    • Land Reclamation: Coastal reclamation covering 50 hectares or more
    • Resort and Recreation: Coastal hotels with more than 80 rooms; hill station resorts covering 50 hectares or more; tourist facilities in national parks
    • Housing: Residential developments covering 50 hectares or more

     

    This is not exhaustive. Any project assessed during screening to have significant environmental impact may be assigned to Category I regardless of type.

    Category II: Partial Assessment or ESMP May Be Sufficient

    Category II projects have moderate or manageable potential impacts. Under the Nigerian EIA process, these projects do not automatically require a full EIA, but they are not exempt from environmental assessment. A partial EIA is typically required, and in some cases FMEnv or the relevant state agency may accept an Environmental and Social Management Plan (ESMP) as an alternative.

    Examples of Category II projects include:

    • Small-scale renewable energy development, including solar minigrids with limited footprints
    • Telecommunication facilities including base transceiver stations and towers
    • Small-scale irrigation and drainage
    • Aquaculture and mariculture
    • Rural water supply and sanitation
    • Road rehabilitation
    • Small-scale quarrying or mining
    • Public facilities such as hospitals, schools and housing below Category I thresholds
    • Small-scale petroleum-related facilities

     

    For example, a solar minigrid deployed in a rural community with a small physical footprint may satisfy requirements through a well-prepared ESMP rather than a full EIA report. A telecom base station in a non-sensitive location may similarly proceed with an ESMP alongside the relevant NESREA or state environmental permit.

    However, if a Category II project is located in or near an Environmentally Sensitive Area — such as mangrove swamps, wetlands, coral reefs, or areas harbouring protected species — it is automatically upgraded to Category I and a full EIA becomes mandatory.

    Category III: No EIA Required

    Category III projects are those expected to have essentially beneficial or negligible environmental impacts. No EIA is required. These include:

    • Institutional development
    • Health and family planning programmes
    • Nutritional and educational programmes
    • Environmental awareness initiatives

     

    For Category III projects, FMEnv may issue an Environmental Impact Statement confirming that no further assessment is required. A full list of categorisation criteria is available through FMEnv’s Environmental Assessment Department.

    Does 'No EIA' Mean No Environmental Obligation?

    Not necessarily. Even where an EIA is not required under the Nigerian EIA process, projects may still need to obtain environmental permits from NESREA, comply with sector-specific environmental regulations, or secure approvals from state environmental agencies such as LASEPA in Lagos, OGEPA in Ogun State, or the Ogun State Ministry of Environment. These obligations exist independently of the FMEnv EIA categorisation.

    Project categorisation under the Nigerian EIA process is not always straightforward. The same project type can fall into different categories depending on its size, location, and potential impacts. Speaking with an accredited environmental consultant before making assumptions will save time and prevent costly mistakes.
